Owner's rep vs. limit of construction phase services

Owner's rep vs. limit of construction phase services

Postby matte » Wed Sep 30, 2015 11:02 am

A201 states that the Architect is an Owner's representative until the Architect issues the final certificate for payment.

B201 states that the limit of Architect’s Construction Phase services is 60 days after Substantial Completion, or anticipated date of Substantial Completion, whichever is earlier.

...does this mean the Architect can be done with construction phase services prior to having issued the final certificate for payment? That the Architect can still be a representative for the Owner after being done with construction phase services? Thank you for any clarification.

[Side note: found this -- http://boiledarchitecture.com/substanti ... ompletion/ -- which seems to have some good information]

I believe Architect basically has to be owner's rep till final payment.
But, if the date of SC got later than the date written in the B102, then architect is entitled to terminate the contract 60 days after the date written in B102, even though architect has not issued certificate of final payment yet?

B201 states that the limit of Architect’s Construction Phase services is 60 days after (Substantial Completion, or anticipated date of Substantial Completion), whichever is earlier.

And after 60days from SC, architect is entitled to receive additional fee to work as owner's representative?

David Doucette's book says it is till final payment.

How can 60d AFTER SubComp be...earlier than SubComp ?

By the way, 5 Basic Service include SD,DD,CD,BP,CA, of which
when dealing with AHJ during DD and CD stages, architect represents
the Owner, specifically said by 210/102.
The role of Architect in BP, as I understand it, is ASSISTANCE, mostly.
And during CA, is not Representative per se, but within an agreed limitation.
What about SD, entitlement phase, dealing with community, env. and
user groups, what role do we have, in black and white ?
Is there AIA wisdom of leaving it blank, or am I missing
something here ?
Anyone ?

Yes.

Yes, David is correct. No slip of the tongue...

No.

Let me attempt to clear this up. Per Section 2.6.1.3 of the B201 and Section 4.2.1 of the A201 the Architect's work ends after the Architect issues the Final Certificate of Payment. All Section 3.3.2.6 (from the B201) is doing is protecting the Architect in the event that the time period between Substantial Completion and Final Completion gets dragged out more than 60 days. If it does get dragged out, all the contract is stating is that the Architect should get additional compensation. That is it. Your job is not finished, not until Final Completion. (Or if the Owner chooses to call you back for his/her post 1-year after Substantial Competition Walk-about... or if you have additional services that require you to work beyond Final Completion...)
