Field Act

Question 1:
Doucette says that the Field Act includes all public schools K-12 and community colleges. Woo says the Field Act includes all public schools except Charter schools (not community colleges).

Which one is it?

I tried reading the field act under the Education Code and got terribly confused. Can someone sum it up for me?

Question 2:
If DSA is the jurisdictional authority for a public school, would they also be the Lead Agency for a public school in a CEQA review?

Field Act is optional for community colleges.

School district is lead agency.

Coach, you say that community colleges are optional under the Field act. However, according to the 2010 DSA introduction circular (below), community colleges are required to get DSA review. This would seem to conflict with what you say. Forgive me if I misunderstood a distinction.

Why would the lead agency be the school district? The lead agency would need to be knowledgable about CEQa, and make a determination if EIR is required. It would seem to be a conflict of interest for the district to be its own lead agency.

That's the way it is. No different than a city or county being lead agency on their own projects.
