Consequential Damages

Postby Sarah be » Tue Dec 17, 2013 1:54 pm

Section 8.3.3 of A201 "does not preclude recovery of damages for delay by either party" BUT the waiver of consequential damages described in 15.1.6 waives damages incurred by the owner for losses of use (among other things) and damages incurred by the contractor for office expenses and business (among other things). Is it possible that you could simultaneously waive your right to make a claim for consequential damages and attempt to recover damages for delay? Such an obvious contradiction can't exist in a contract so I know I'm missing something. Thoughts?
